Based in Hoboken, New Jersey, AESI has handled more than 5,000 projects at industrial and commercial properties, offering environmental due diligence; soil and groundwater investigations and remediation; asbestos and wetlands surveys and related services. The firm’s professionals have expertise in geo-scientific and environmental disciplines such as hydrogeology, environmental engineering, facility assessments and building inspections, all with required company certifications.

AESI has two decades of experience in the regulatory, technical, and management aspects of environmental issues in New Jersey, New York and across the U.S. The firm’s scope of services complements its clients’ strategic business plans, and each project is assigned to a seasoned manager based on specific technical requirements and the nature of the compliance issues involved. SIGNIFICANCE AND SERVICES

Today’s real estate market, particularly in New Jersey and New York, is largely influenced by environmental concerns. AESI is staffed and equipped to address the issues associated with the evaluation of commercial and industrial properties in due diligence. This gives the firm a distinct advantage over organizations that provide real
estate environmental consulting services as a supplemental service.

Over the past 10 years, AESI has experienced substantial growth, with revenues increasing fourfold. Projects have ranged from asbestos evaluation for 1,500 properties in 47 states for a national retailer to evaluating 1,500 homes impacted by Super Storm Sandy including LSRP services for a city in Hudson County; and over 100 remediation projects for Newark and Port Elizabeth-related industrial and logistics businesses. The firm routinely performs Phase I Environmental Site Assessments for property buyers, sellers and lenders to help establish “innocent land owner” status in commercial real estate property transactions.

Under the New Jersey Department of Environmental Protection (NJDEP) LSRP Program, the firm has closed 140 LSRP matters and has 314 total LSRP projects.

AESI’s range of environmental real estate assessment, investigation and remediation services includes:

LSRP Consulting

AESI employs multiple Licensed Site Remediation Professionals who work with clients to investigate and remediate properties and Areas of Concern (AOC) without NJDEP oversight. AESI is responsible for completing the remediation of contaminated sites to achieve full compliance with the Technical Requirements for Site Remediation (Technical Requirements) and other applicable standards. To date, AESI has issued more than 140 Response Action Outcomes (RAOs).

Asbestos Surveys

AESI has performed certified asbestos hazard surveys in compliance with the Occupational Safety and Health Administration (OSHA) asbestos rule (29 CFR 1926.1101) at over 1,000 locations in 30 states. At each location, AESI has provided specific recommendations for further action, which either resulted in full-scale abatement activities, preparation and implementation of Operations & Maintenance (O&M) Plans or both.

Soil & Groundwater Remediation

Federal and state environmental chemical discharge acts and regulations have become part of the many liabilities real estate owners, operators and tenants (Responsible Parties (RPs) have had to build into their management process. AESI provides soil and groundwater remediation at affordable costs to relieve the RPs of these liabilities. They customize remediation programs based on each client’s specific site conditions, financial objective and risk tolerance.

Wetlands Surveys

Prior to development, property owners in New Jersey are required by the DEP to perform certain wetland reviews or screenings. AESI’s Wetland Specialists perform “walkthrough” evaluations using a “three-parameter approach” (hydrology, soils and vegetation) pursuant to N.J.A.C. 7:7A et. Seq. Once the site walkthrough is complete, they will prepare a summary letter addressing the findings of the wetlands screen. The firm’s Wetlands experts work with property developers to obtain Wetlands Letters of Interpretation (LOIs), Transition Area Waivers and other approvals.

Phase I Environmental Site Assessments

The Phase I Environmental Site Assessment is an essential element in establishing “innocent landowner” status in property transactions. It is the first step in evaluating a property’s environmental status and can help limit lender and potential owner liability should the property be found to pose an environmental risk. AESI personnel have performed more than 1,000 Phase I Environmental Site Assessments, Preliminary Assessments, and Site Investigations since 1997. The firm’s credentials exceed the requirements of all major financial institutions and are continuously refined to accommodate changes in legal guidance, client objectives and state regulations.

Expert Testimony

AESI’s leadership provides expert testimony and litigation support on multiple environmental matters. The firm performs environmental due diligence at industrial and commercial properties in New Jersey and New York and can testify with experience to the standard of care in the industry. Cases include municipal land use, condemnations, Responsible Party designation, and cost engineering. AESI’s experts testify at many forums including trials, mediation, municipal boards, depositions, etc.

EXECUTIVE LEADERSHIP

Michael J. Novak, LSRP, president, has over 29 years of experience in the management and implementation of environmental consulting and remediation services. He has directed over $75 million in environmental projects at over 5,000 client locations across 47 states, and was among the first individuals to be issued a license by the State of New Jersey under its Licensed Site Remediation Professional (LSRP) program. His areas of expertise include: environmental due diligence; brownfields redevelopment; soil and groundwater investigation and remediation; underground storage tank compliance; hazardous waste management; and regulatory compliance. As an expert witness, Novak has testified successfully in court and been deposed on multiple matters involving environmental and regulatory compliance issues. He is actively involved in Hudson County not-for-profit organizations and has served on the boards of professional organizations including the Hudson County Chamber of Commerce, Hoboken Rotary, 200 Club of Hudson County, and Hoboken Zoning Board of Adjustment. Novak is a former president of the Hoboken Chamber of Commerce and was honored with an Excellence Award by the New Jersey Business and Industry Association’s (NJBIA) in 2005. He is currently a member of the Advisory Board of the Rutgers School of Business, Center for Real Estate, and serves on the Advisory Board of Investors Bank and the Ambassador’s Board of Connect One Bank. In addition, he is a speaker on environmental matters for Lorman Education Services and frequently addresses real estate industry groups on environmental topics.
